Welcome to BongMood. These Terms of Service ("Terms") govern your access to and use of the BongMood website, online store, products, and services (collectively, the "Services").

By accessing or using our Services, placing an order, or purchasing a product from BongMood, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services or place an order.

1. About BongMood

BongMood operates an online store offering products that may be produced and fulfilled through print-on-demand and other third-party fulfillment providers.

Our products are generally made after an order is placed. As a result, products may not be manufactured or stocked in advance.

2. Eligibility and Use of the Website

BongMood's website and products are intended for customers in the United States.

At this time, BongMood only accepts orders for delivery within the United States. We may expand our shipping destinations in the future and may update these Terms accordingly.

There is no age restriction on the general content of our website. However, by using the Services or placing an order, you represent that you have the legal capacity to enter into an agreement and that the information you provide to us is accurate and complete.

3. Products and Product Information

We make reasonable efforts to display our products, designs, colors, images, descriptions, and other information accurately.

However:

  • Actual colors may vary depending on your device or screen.

  • Product dimensions and measurements may have reasonable variations.

  • Product availability may change without notice.

  • Product images may be representative and may not always exactly reflect the physical product.

  • Print-on-demand products may have minor variations resulting from the manufacturing and printing process.

We do not guarantee that product descriptions, images, colors, pricing, availability, or other information on the website will always be completely accurate, current, or error-free.

4. Pricing

All prices displayed on BongMood are in U.S. dollars (USD) unless otherwise stated.

We reserve the right to change product prices at any time without prior notice.

A price change will not affect an order that has already been accepted and confirmed, except where an order is affected by an obvious pricing or listing error.

Applicable taxes may be added to your order at checkout where required by applicable law.

5. Free Shipping

BongMood currently offers free shipping on eligible orders within the United States.

Shipping costs associated with eligible orders are incorporated into our product pricing and are not separately charged as a shipping fee at checkout.

We reserve the right to change our shipping policy or introduce shipping charges in the future. Any applicable shipping charges will be displayed before you complete your purchase.

6. Orders and Order Acceptance

When you place an order through our website, you are making an offer to purchase the products in your order.

After placing an order, you may receive an order confirmation. An order confirmation does not necessarily mean that BongMood has accepted the order.

We reserve the right to accept, decline, cancel, or limit any order at our discretion, including where:

  • A product becomes unavailable.

  • There is an error in product information or pricing.

  • There is an apparent technical or system error.

  • We suspect fraudulent, unauthorized, or unlawful activity.

  • We are unable to fulfill the order through our fulfillment or manufacturing providers.

  • The order otherwise violates these Terms or applicable law.

If we cancel an order after payment has been received, we will provide an appropriate refund of the amount charged for the canceled order.

7. No Order Cancellations

Because BongMood products may be made specifically after an order is placed, orders cannot be canceled after they are submitted.

Please carefully review your products, sizes, colors, quantities, shipping information, and other order details before completing your purchase.

8. Returns, Refunds, and Damaged Products

Our returns and refunds are governed by our separate Return & Refund Policy, which is incorporated into these Terms by reference.

The Return & Refund Policy explains circumstances in which BongMood may provide a replacement, refund, or other resolution, including situations involving damaged, defective, or incorrectly fulfilled products.

Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable law.

9. Shipping and Delivery

BongMood uses third-party print-on-demand, fulfillment, and shipping providers to manufacture and deliver products.

Estimated delivery times may vary depending on the product, production time, shipping carrier, destination, and other circumstances.

We are not responsible for delays caused by circumstances outside our reasonable control, including:

  • Carrier delays

  • Weather

  • Natural disasters

  • Transportation disruptions

  • Customs or governmental delays

  • Incorrect or incomplete shipping information provided by the customer

  • Other events outside our reasonable control

If your order appears to be lost or has not arrived as expected, please contact us at bongmoodcare@gmail.com so we can review the situation.

10. Customer Information and Order Details

You are responsible for providing accurate and complete information when placing an order.

This includes your:

  • Name

  • Shipping address

BongMood is not responsible for problems caused by incorrect or incomplete information provided by the customer.

11. Intellectual Property

All content and materials available through the BongMood Services, including, but not limited to:

  • BongMood name and branding

  • Logos

  • Product designs

  • Graphics

  • Product images

  • Website text

  • Product descriptions

  • Website layout and design

  • Original artwork

  • Other original materials

are owned by or licensed to BongMood and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, publish, transmit, display, create derivative works from, or commercially exploit BongMood's content or intellectual property without our prior written permission.

Purchasing a BongMood product does not transfer ownership of any BongMood intellectual property to you.

12. Customer Reviews, Photos, and Other Submissions

If BongMood allows you to submit reviews, photographs, testimonials, comments, feedback, or other content ("Customer Content"), you retain ownership of your Customer Content.

However, by submitting Customer Content to BongMood, you grant BongMood a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, display, distribute, and otherwise use that content for purposes related to operating, promoting, and marketing BongMood and its products.

This may include displaying Customer Content:

  • On our website

  • On product or collection pages

  • On social media

  • In advertisements

  • In promotional materials

  • In email marketing

  • In other BongMood marketing channels

You represent that you have the necessary rights and permissions to submit the Customer Content and that your submission does not violate another person's rights.

We reserve the right to remove Customer Content that we believe is unlawful, inappropriate, misleading, abusive, offensive, or otherwise inconsistent with our policies.

These may include Shopify, payment providers, print-on-demand providers, fulfillment providers, shipping carriers, email service providers, analytics providers, and other technology or service providers.

BongMood is not responsible for the independent acts, policies, availability, or performance of third-party services that are outside our reasonable control.

These links are provided for convenience. BongMood does not control and is not responsible for the content, availability, security, privacy practices, or policies of third-party websites.

Your use of third-party websites is subject to their applicable terms and policies.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the BongMood Services are provided on an "as is" and "as available" basis.

We do not guarantee that:

  • The website will always be available or uninterrupted.

  • The website will be error-free.

  • Product information will always be completely accurate.

  • Products will always be available.

  • The Services will be free from viruses or other harmful components.

  • The Services will meet every customer's particular expectations or requirements.

Nothing in these Terms excludes any warranty, representation, or consumer right that cannot legally be excluded under applicable law.

17. Limitation of Liability

To the fullest extent permitted by applicable law, BongMood and its owners, officers, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services or purchase of products.

To the fullest extent permitted by law, BongMood's total liability arising from or relating to an order or the Services will not exceed the amount you actually paid to BongMood for the specific product or order giving rise to the claim.

This limitation does not apply where liability cannot legally be limited or excluded under applicable law.

18. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless BongMood and its owners, officers, employees, contractors, service providers, and affiliates from claims, liabilities, damages, losses, costs, and expenses arising from:

  • Your misuse of the Services.

  • Your violation of applicable law.

  • Your violation of another person's rights.

  • Customer Content you submit to BongMood.

We may suspend or terminate your access to the Services if we reasonably believe that you have violated these Terms, engaged in fraudulent or unlawful activity, or otherwise misused the Services.

Termination will not affect provisions of these Terms that by their nature should continue after termination, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

20. Governing Law

These Terms and your use of the Services are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

21. Dispute Resolution and Arbitration

We want to resolve customer concerns efficiently and without unnecessary legal proceedings.

Before starting a formal dispute, you agree to first contact BongMood at bongmoodcare@gmail.com and give us a reasonable opportunity to resolve the issue informally.

Binding Individual Arbitration

Except where prohibited by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or a purchase from BongMood that cannot be resolved informally will be resolved through binding individual arbitration rather than in court.

The arbitration will be conducted by a mutually agreed-upon arbitrator or, if the parties cannot agree, through a recognized arbitration service under its applicable consumer arbitration rules.

The arbitration will be conducted on an individual basis. The arbitrator may award the same types of individual remedies that a court could award under applicable law.

Small Claims Exception

Either party may bring an individual claim in a qualifying small claims court if the claim meets the requirements of that court.

No Class Actions

To the fullest extent permitted by applicable law, disputes must be brought on an individual basis.

You and BongMood agree that neither party will participate in a class action, class-wide arbitration, representative action, or other proceeding in which one party acts on behalf of or seeks relief for other people.

This provision does not apply where such a waiver is prohibited by applicable law.

Arbitration Location

Unless the parties agree otherwise or applicable law requires a different location or procedure, arbitration will be conducted remotely or in a reasonably convenient manner, rather than requiring either party to travel unnecessarily.

Nothing in this section prevents a party from seeking temporary or emergency equitable relief where permitted by law.

22. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, products, services, technology, or applicable legal requirements.

When we update these Terms, we will post the revised version on our website and update the "Last updated" date.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms, to the extent permitted by law.

23. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

24. Entire Agreement

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the agreement between you and BongMood regarding your use of the Services and purchases from BongMood, except where additional terms are presented to you for a particular product or service.

If there is a conflict between these Terms and another applicable policy, the specific policy will control with respect to the subject matter covered by that policy.
